LITIGATION SUPPORT AND EXPERT TESTIMONY

LabCorp has extensive experience in legal proceedings based on its contracts with the Army, Air Force and the Navy/Marines. Our results have been used as evidence, backed up by either documentation or expert testimony in over 600 court-martials, and the laboratory has maintained an excellent reputation for providing quality data which can stand up to legal scrutiny.

In the event a civil lawsuit is initiated against any customer by an individual challenging the accuracy, reliability, and/or the chain-of-custody associated with LabCorp's results, LabCorp will provide expert testimony necessary to support the data.

LabCorp's experience has shown that in most contested cases, providing documentation of the laboratory analysis and chain of custody resolves the matter.  Our customized litigation support package includes certified true copies of all chain of custody documents relating to the sample in question and complete analytical information.

The Director of Toxicology oversees the Expert Witness Program at the laboratory with expert witnesses on staff who are available to support the laboratory results in legal proceedings.  These individuals are qualified to testify as to the analytical accuracy, standard operating procedures, and test results. Upon written notification from the client, the Expert Witness will be scheduled.

As an additional service, LabCorp will make available the services of the Responsible Person of the laboratory or other forensic toxicology employees to consult with the Medical Review Officer or Drug Program Coordinator.  These consultations may be required to determine whether positive findings may be justified by physical conditions, prescription drugs, or other legal explanation.
