Terms for Customer Agreement

Hirecheck Inc. is the owner of the computer software program (known as HireCheck) and all copyrights, trademarks, and other rights and interests in the Program ("the Program"). The term "Program" includes all written or printed documentation regarding the Program and use of the Program. The License is for the use of the Program only by the Customer at the Customer's business address, and the Customer will not distribute copies of the Program or its documentation. The Customer may not sublease, assign, or transfer all or any part of the License.

Hirecheck Inc. Agrees to:
  1. Grant Customer a non-transferable, non-exclusive license to use the Program subject to the terms and restrictions in this Agreement. The customer may copy the Program for backup purposes only.

  2. Continue the License in effect until terminated. The customer may terminate this License by destroying all originals and copies of the Program and its documentation.

  3. Follow reasonable quality assurance procedures to assure maximum possible accuracy of information. If any such information is questioned by he customer or their applicant, Hirecheck Inc. will re-verify the information at no cost to the Customer. Hirecheck Inc.'s response will be done in a timely manner

  4. Maintain confidentiality of its data acquisition and verification methodology.

  5. Provide Customer Service support for questions, re-training, and technical support , as needed.

  6. Maintain archival copies of all reports for a period of 7 years for backup purposes.

  7. Maintain the confidentiality of all search requests and reports on customer's applicants.

Customer Agrees:
  1. The License to use HireCheck will terminate if the Customer fails to comply with any terms or conditions of this License, in which case the Customer agrees to destroy the Program and documentation in all forms.

  2. The amount of any liability of Hirecheck Inc. under this Agreement or otherwise shall not exceed the License fee paid by the Customer for the Program. In no event will Hirecheck Inc. be liable to Customer for damages, including lost profits, lost savings, or other damages arising out of  he use or inability to use the Program, or arising from the Customer's interpretation or use of the data furnished by Hirecheck Inc.. Any legal action will be filed in Penellas County, Florida.

  3. To accept responsibility for ordering and using information provided by Hirecheck Inc. in accordance with the Fair Credit Reporting Act and Chapter Nine of the Technical Assistance Manual (Title 1) for the Americans with Disabilities Act. Further, it is aware that certain states have stricter "Human Rights," ADA based statutes, and privacy laws for employers, and that compliance with these laws is the responsibility of the customer.

  4. In accordance with the Federal Fair Credit Reporting Act, to disclose to the applicant in writing in a document that consists solely of such disclosure that report may be procured, to obtain the applicant's written authorization for such reports, and to keep such authorization on file. When adverse actions are taken based on consumer reports, customer will advise the applicant of the action, provide them with the report which was the basis for such action and provide them with Hirecheck Inc.'s name and how to contact Hirecheck Inc.. To keep all reports confidential, use only for the purpose intended and not disclose to unrelated third parties.

  5. The information is obtained and managed by the fallible human sources, and that, for the fee charged, Hirecheck Inc. cannot guarantee, nor will be liable for the accuracy or the depth of information provided, regardless of the origin of the inaccuracies.

  6. To assume responsibility for the final verification of the applicant's identity. It will base hiring decisions on its own policies, and keep all reports strictly confidential.

  7. To pay for services as agreed in Section B of this document. It agrees to pay a finance charge of 1 1/2% per month for any accounts in arrears. If the account goes to collection, Customer agrees to pay all expenses, including legal fees.

  8. Hirecheck Inc. employees will be glad to help customers understand a report, but they are not allowed to render any legal opinions regarding information contained in the transmitted report.
